Terms of Service for Travel Buddy

1. Acceptance of Terms
By downloading, installing, or using Travel Buddy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms form a legally binding agreement between you and Travel Buddy ("we", "our", "us").
2. Description of Service
Travel Buddy is a collaborative trip planning application that allows users to:
- Create and manage travel itineraries
- Add activities, locations, and notes to trips
- Invite others to collaborate on trips
- Comment on and vote for activities
3. Eligibility
You must be at least 13 years old to use Travel Buddy. By using the App, you represent that you meet this requirement. Users between 13 and 18 should have parental consent.
4. Account Registration
- You must provide a valid email address to create an account
- You are responsible for maintaining the confidentiality of your password
- You are responsible for all activity that occurs under your account
- You must notify us immediately at support@travelbuddy.group if you suspect unauthorised access to your account
- You may not create accounts for others without their consent
5. Acceptable Use
You agree not to use Travel Buddy to:
- Upload, post, or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Harass, bully, or intimidate other users
- Impersonate any person or entity
- Collect or harvest personal information of other users without their consent
- Attempt to gain unauthorised access to any part of the App or its infrastructure
- Use the App for any commercial purpose without our prior written consent
- Interfere with or disrupt the App's servers or networks
- Violate any applicable local, national, or international laws
6. User-Generated Content
- You retain ownership of the content you create within Travel Buddy (trips, activities, comments)
- By creating content, you grant us a limited, non-exclusive licence to store and display that content solely for the purpose of providing the service to you and your trip collaborators
- You are solely responsible for the content you create
- We do not review user content in advance but reserve the right to remove content that violates these Terms
7. Collaboration Features
- When you invite another user to a trip, that user will have access to view and edit the trip's content
- You are responsible for who you invite to your trips
- You can remove collaborators from your trips at any time
8. Subscription and Payments
Travel Buddy offers a free tier with core features. Premium features (if and when introduced) will be offered via in-app purchase subject to additional terms at that time. Current paid features are clearly marked in the App.
9. Intellectual Property
- The Travel Buddy app, its design, logo, and original content are owned by us and protected by intellectual property laws
- You may not copy, modify, distribute, or reverse-engineer any part of the App
- These Terms do not transfer any intellectual property rights to you
10. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in conduct that we determine, in our sole discretion, is harmful to other users or the App
You may delete your account at any time via the in-app option or by emailing support@travelbuddy.group. Upon termination, your data will be deleted as described in our Privacy Policy.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted, error-free, or secure
- Any errors will be corrected
- The App is free of viruses or other harmful components
Travel Buddy provides tools for trip planning only. We are not responsible for the accuracy of place information, travel conditions, or any outcomes related to trips planned using the App.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR €10 IF YOU HAVE PAID NOTHING).
13. Governing Law
These Terms are governed by the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy.
If you are a consumer in the European Union, you may also be entitled to the mandatory consumer protection laws of your country of residence.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes via the App or by email. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
